1. The Service
Local Brazilian provides a subscription-based software service for learning and maintaining Brazilian Portuguese through daily content about Brazil. The Service may include websites, applications, Portuguese and English reading experiences, Brazil briefings, practice exercises, account features, subscriptions, in-app purchases, and support.
The Service is provided on an as available basis. We may modify, suspend, or discontinue any part of the Service at any time for operational, security, legal, maintenance, or business reasons.
2. Accounts and Eligibility
You must be at least 13 years old to use the Service. If you purchase a subscription or in-app purchase, you must be old enough to form a binding contract in your jurisdiction or have permission from a parent or legal guardian.
You agree to provide accurate account information and keep it current. You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials.
You may sign in using supported third-party authentication providers. Your use of those providers may also be subject to their own terms and policies.
3. Acceptable Use
You may not:
- Use the Service in violation of any law or regulation.
- Submit false, misleading, fraudulent, abusive, or infringing content.
- Impersonate another person or business.
- Access or attempt to access another user's account.
- Interfere with, disrupt, probe, scan, or test vulnerabilities in the Service.
- Upload malware, spam, or harmful code.
- Scrape, crawl, copy, or harvest data from the Service without permission.
- Reverse engineer, decompile, or attempt to extract source code or system architecture except where prohibited by law.
- Circumvent usage limits, payment requirements, or access controls.
- Use the Service in a way that could harm Local Brazilian, users, or the public.
Enforcement
We may suspend, restrict, or terminate access if we reasonably believe there has been a violation of these Terms, a security risk, non-payment, abuse, or if required by law.
4. Your Content
Your Content means content you submit to the Service, such as profile information, messages, feedback, answers, practice inputs, saved preferences, uploads, notes, or other materials where those features are available.
As between you and Local Brazilian, you retain ownership of Your Content.
You grant Local Brazilian a limited, non-exclusive license to host, copy, process, transmit, display, and modify Your Content as needed to provide, secure, maintain, and improve the Service.
You represent that you have the rights needed to provide Your Content and that it does not violate any law, third-party right, or these Terms.
We may remove or restrict Your Content if we believe it violates these Terms, creates risk, or may harm users, Local Brazilian, or others.
5. Subscriptions, Billing, and In-App Purchases
Some parts of the Service are free, and others require a paid subscription or in-app purchase.
If you buy a subscription or in-app purchase, we will show the applicable pricing and purchase terms before checkout. Payments may be processed by third-party payment providers, app stores, or platform providers, and their terms may also apply.
Subscriptions may renew automatically unless canceled before renewal. Fees are non-refundable except as required by law or stated at the time of purchase.
We may change pricing or paid features in the future. Pricing changes for existing subscriptions will apply at the next renewal unless otherwise stated.
6. Third-Party Services
The Service may include links, sign-in providers, payment providers, analytics providers, hosting providers, app stores, or other third-party services.
Third-party services are governed by their own terms and privacy policies. Local Brazilian is not responsible for third-party services, outages, changes, content, or data practices.
7. Privacy
Our Privacy Policy explains how we collect, use, store, and share information.
By using the Service, you also agree to our Privacy Policy.
8. Intellectual Property
The Service, including software, design, branding, logos, text, graphics, interfaces, features, and underlying technology, is owned by Local Brazilian and its licensors, except for Your Content and third-party content.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your personal or internal business use during your subscription term or permitted free access.
These Terms do not give you permission to use Local Brazilian's name, logo, branding, or intellectual property except as necessary to use the Service.
9. Data Retention and Loss
You are responsible for maintaining independent copies of any content or information you need to keep.
Local Brazilian does not guarantee data retention, availability, or recovery following suspension, termination, account deletion, service changes, or technical failure.
10. Disclaimers
The Service is provided as is and as available.
To the maximum extent permitted by law, Local Brazilian disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the Service will be uninterrupted, secure, error-free, accurate, complete, current, or available at any particular time or location.
11. Limitation of Liability
To the maximum extent permitted by law, Local Brazilian will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, loss of goodwill, or other intangible losses.
To the maximum extent permitted by law, Local Brazilian's total liability for any claim related to the Service or these Terms will not exceed the greater of $100 or the amount you paid to Local Brazilian for the Service in the 12 months before the event giving rise to the claim.
12. Indemnification
You agree to defend and indemnify Local Brazilian against third-party claims arising out of Your Content, your use of the Service, your violation of these Terms, your violation of law, or your violation of another person's rights.
13. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the Last Updated date above.
If changes are material, we may provide additional notice. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law rules.
15. Force Majeure
Local Brazilian is not liable for delays or failures caused by events beyond our reasonable control, including internet outages, hosting failures, third-party service failures, labor disputes, governmental actions, natural disasters, or security incidents.
16. Entire Agreement
These Terms, together with the Privacy Policy and any purchase terms shown at checkout, make up the entire agreement between you and Local Brazilian for the Service unless replaced by a separate written agreement.
